What to know about premises liability claims
Premises liability covers a wide range of injuries: falls, negligent security (assaults in poorly-lit parking lots, apartments with broken locks, or venues without adequate staffing), swimming pool injuries, dog attacks on property, elevator and escalator failures, and injuries from falling merchandise.
Different visitors are owed different levels of care. Invitees (customers, guests) are owed the highest duty; licensees (social guests) are owed a lesser duty; even trespassers cannot be intentionally harmed. Most of our cases involve invitees on commercial or rental property.
Negligent security cases are especially fact-intensive. We look at prior crime in the area, whether the owner had actual notice of previous incidents, industry security standards for that type of property, and whether reasonable measures (lighting, cameras, patrols, functioning locks) would have prevented the incident.
Damages typically include medical bills, ongoing treatment, lost income, and pain and suffering. In serious cases involving repeated failures to address known dangers, punitive damages may be recoverable.
