2-Year Statute of Limitations
In March 2023, Florida shortened its personal injury statute of limitations from four years to two years for most negligence claims accruing on or after March 24, 2023. That means most injury lawsuits must be filed within two years of the incident. Wrongful death claims are also generally two years. Claims against government entities have shorter notice deadlines and specific procedural requirements — call quickly to preserve your options.
Modified Comparative Negligence (50% Bar)
As of March 2023, Florida uses a 'modified' comparative negligence rule with a 50% bar. You can still recover damages if you were partially at fault — your recovery is reduced by your percentage of fault — but if a jury finds you more than 50% responsible, you generally recover nothing. This makes fault allocation critical, and it's exactly the kind of argument insurance companies use to push cases below the 50% line.
PIP & Florida's No-Fault Auto System
Florida is a no-fault state for auto insurance. Every registered driver must carry Personal Injury Protection (PIP) — typically $10,000 — which covers 80% of your medical bills and 60% of lost wages up to the policy limit, no matter who caused the crash. But PIP has strict deadlines (initial treatment within 14 days) and doesn't cover pain and suffering. To recover beyond PIP, your injury generally must meet Florida's 'serious injury' threshold.
