2-Year Statute of Limitations

In most California personal injury cases, you have two years from the date of injury to file a lawsuit. Miss the deadline and your claim is almost always barred — no matter how strong the underlying facts. Claims against government entities (cities, counties, the state) have much shorter deadlines, often just six months to file a government tort claim. When in doubt, call sooner rather than later.

Pure Comparative Negligence

California follows a 'pure comparative negligence' rule: you can still recover damages even if you were partially at fault for the accident. Your recovery is reduced by your percentage of fault. If you're found 30% responsible for a $100,000 case, you recover $70,000. Even a plaintiff found 90% at fault can still recover 10%. This is one of the most plaintiff-friendly rules in the country.

At-Fault Auto Insurance State

California is an at-fault (tort) state for auto accidents — the driver who caused the crash is financially responsible. State minimum liability limits are low, which is why we routinely pursue your own uninsured and underinsured motorist coverage when the at-fault driver's policy isn't enough.
